Microsoft for Startups Pegasus Customer Community – Program Agreement    

By submitting the application to join The Microsoft for Startups Pegasus Customer Community (“MFSPCC”), you agree to the following terms:   

You represent that you are 18 years or older and that you are formally affiliated with or employed by the organization you specify in your application. All MFSPCC applicants and members represent themselves as individuals. You may, but are not required to, have legal authority to officially enter into this Agreement on behalf of your organization. If you do not accept these terms, then you will not be allowed to participate in the MFSPCC. Microsoft reserves the right to update these terms at any time without notice to you. 

By joining the MFSPCC, you give us permission to communicate with you to (a) administer the Microsoft for Startups Pegasus Customer Community; (b) give you information about MFSPCC opportunities, including but not limited to: sending you periodic updates via email; providing information about exclusive events and initiatives for you and your organization,; inviting you to participate in programs managed by Microsoft for Startups for the community; soliciting opt-in information in the form of optional surveys; and sharing promotional information about the Microsoft for Startups portfolio; and (c) reference your company name, logo, and individual quote(s) as it pertains to your participation in MFSPCC.

These terms apply to your MFSPCC membership, including any benefits or opportunities extended to you through a related MFSPCC program. Such programs may also carry additional terms. In the event there is a conflict between these terms and any other terms associated with such program, those program terms will control. Membership within the MFSPCC may be an eligibility requirement to participate in various Microsoft for Startups events and initiatives intended exclusively for the MFSPCC. Should you wish to share information about the MFSPCC or related MFSPCC programs with other individuals or organizations in your network, you are welcome to share the MFSPCC link. Recipients will be evaluated for membership as per the stated MFSPCC program criteria, outlined herein.    

Microsoft for Startups retains the authority to accept or reject any individual request or membership within the MFSPCC. Requests are evaluated on the basis of an individual’s affiliation with a publicly verifiable and qualifying organization that has the propensity and ability to innovate with Microsoft and/or purchase startup solutions. Such qualifying organizations may include, but are not limited to, Enterprise and SMC organizations, looking for solutions across, but not limited to, Retail, Healthcare & Life Sciences, AI, Cybersecurity, Financial Services and Insurance, Energy, Manufacturing, and/or Public Sector. Individuals applying for MFSPCC membership using their personal email addresses will be rejected on the grounds that their identity and affiliation cannot be adequately verified. Individuals are not required to hold a certain title or position within their affiliated organization in order to be considered eligible for MFSPCC membership.  

Microsoft for Startups retains the ability to deny or revoke membership from any participant in the MFSPCC for any reason and at Microsoft for Startups’ sole discretion. Microsoft for Startups will communicate acceptance or rejection of MFSPCC requests directly to individuals via the email address provided in the form.  

Active members of the MFSPCC can opt out of the MFSPCC and the Agreement at any time by emailing PegasusCommunity@microsoft.com.    

We may suspend or terminate the MFSPCC at any time at our sole discretion. We will give you notice before we suspend or terminate the MFSPCC, except in cases in which we reasonably believe we need to suspend or terminate the MFSPCC immediately. 

If you or members of your organization give feedback about any Microsoft software, products, services or documentation, you give to Microsoft, without charge, the right to use, share and commercialize such feedback in any way and for any purpose. You or members of your organization will not give feedback that is subject to a license that requires Microsoft to license its software, products, services, or documentation to third parties because Microsoft includes such feedback in them. These rights survive these terms.   

The failure of Microsoft to exercise or enforce any rights or provisions in these terms will not constitute a waiver of such right or provision. If any part or provision of these terms is found to be unenforceable, such part or provision may be modified to make the terms as modified legal and enforceable. The balance of the terms will not be affected.   

You acknowledge that your participation in the MFSPCC does not create a partnership, agency or employer-employee relationship with Microsoft or any of its suppliers. Neither you nor any members of your organization will make any statements on behalf of Microsoft or its suppliers about Microsoft or its suppliers, or any of Microsoft’s or its suppliers’ products or services.   

By signing up for the MFSPCC, you agree that you have read and agree to (i) the Microsoft Privacy Statement and give permission to the MFSPCC to collect your data in connection with your participation in the MFSPCC and (ii) Microsoft’s Website Terms of Use.
